Please read these Terms and Conditions ("Terms") carefully before purchasing or using any guide, document, or digital product (each a "Guide") from Marine Tech ("we," "us," "our"). By purchasing a Guide, accessing our website, or downloading any content, you ("Customer," "you," "your") agree to be bound by these Terms in full. If you do not agree to these Terms, do not purchase, access, or use our Guides.

1. Nature of the Products

1.1 Our Guides are general, informational, and educational content relating to boat maintenance, cleaning, winterization, and related topics. They are provided for reference purposes only.

1.2 Our Guides are not a substitute for professional marine surveying, marine engineering advice, manufacturer guidance, or the judgment of a qualified boat yard, rigger, or marine technician. Boats, materials, equipment, and local conditions vary enormously, and no general guide can account for the specific condition, age, design, or history of any individual vessel.

1.3 We make no representation that any Guide is complete, accurate, current, or suitable for your particular vessel, equipment, climate, jurisdiction, or circumstances.

2. Assumption of Risk and Customer Responsibility

2.1 You are solely responsible for how you use, interpret, and apply the information contained in any Guide. Any decision to perform, delay, modify, or omit any maintenance, winterization, cleaning, repair, or other task described in a Guide is made entirely at your own discretion and at your own risk.

2.2 You acknowledge that working on or around boats, marine equipment, chemicals, tools, machinery, electrical systems, fuel systems, and bodies of water carries inherent risks, including but not limited to risk of personal injury, death, property damage, and damage to your vessel or the vessels or property of others.

2.3 You are responsible for assessing whether any technique, product, chemical, or procedure described in a Guide is safe and appropriate for your vessel, your skill level, your equipment, applicable local laws and regulations, and the specific circumstances in which you intend to use it. Where a Guide recommends consulting a professional, obtaining a professional assessment, or following a manufacturer's instructions, you are responsible for doing so before proceeding.

2.4 We are not present at, and have no control over, any location where you choose to apply the information in a Guide. We have no ability to supervise, inspect, or verify your work, and we assume no responsibility for the outcome of any task you undertake.

3. No Warranties

3.1 Guides are provided strictly "as is" and "as available," without warranty of any kind, whether express, implied, or statutory, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by applicable law.

3.2 We do not warrant that following any Guide will achieve any particular result, prevent any particular type of damage, satisfy any manufacturer's warranty conditions, satisfy any insurance policy's conditions, or comply with any particular law, regulation, or marina/boat yard rule applicable to you.

4. Limitation of Liability

4.1 To the fullest extent permitted by applicable law, Marine Tech, its owners, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages of any kind arising out of or in connection with your purchase, access, or use of (or inability to use) any Guide, including but not limited to: personal injury; death; damage to your vessel, its systems, or its contents; damage to third-party property; loss of use of your vessel; cost of repairs; cost of professional remediation; loss of income or profits; or any other loss, however arising, whether in contract, tort (including negligence), strict liability, or otherwise, even if we have been advised of the possibility of such damages.

4.2 In any jurisdiction where the above exclusion of liability is not permitted in full, our total aggregate liability to you for any and all claims arising from or relating to a Guide shall not exceed the amount you actually paid for that specific Guide.

4.3 Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited under applicable law (for example, liability for death or personal injury caused by gross negligence or willful misconduct, or liability that cannot be excluded under applicable consumer protection law). Where such liability cannot be excluded, it is limited to the minimum extent permitted by law.

5. Indemnification

5.1 To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Marine Tech and its owners, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or application of any Guide; (b) any task, repair, or maintenance activity you perform based on a Guide; or (c) your breach of these Terms.

6. No Refunds

6.1 All sales of Guides are final. Due to the digital, instantly deliverable nature of our products, we do not offer refunds, exchanges, credits, or cancellations once a Guide has been purchased and/or made available for download or access, except where required by applicable law.

6.2 We encourage you to carefully review the description, table of contents, and any preview material available for a Guide before purchasing, as no refund will be issued for a Guide that does not meet your expectations, is not suited to your particular vessel or needs, or that you simply decide you no longer want.

6.3 Statutory rights notice: Some jurisdictions grant consumers a statutory right to cancel or withdraw from a purchase of digital content within a certain period, which cannot be waived by these Terms except where the consumer has expressly consented to immediate access/performance and acknowledged the resulting loss of any such right. Nothing in this Section 6 is intended to remove any statutory right you may hold under the mandatory law of your jurisdiction; if a conflict exists between this Section and such mandatory law, the mandatory law will govern solely to the extent required.

7. Intellectual Property

7.1 All Guides, and all content therein, are protected by copyright and remain the property of Marine Tech (or its licensors). Purchase of a Guide grants you a limited, non-exclusive, non-transferable license to use the Guide for your own personal, non-commercial reference.

7.2 You may not resell, redistribute, publicly share, republish, or use any Guide for commercial purposes without our prior written consent.

8. Third-Party Products, Tools, and Services

8.1 Guides may reference specific products, brands, tools, or chemicals for illustrative purposes. Such references do not constitute an endorsement, guarantee, or warranty of any third-party product, and you are responsible for reviewing manufacturer instructions, safety data sheets, and compatibility with your vessel before using any product.

9. Changes to Guides and Terms

9.1 We may update, revise, or discontinue any Guide at any time without notice. We do not guarantee that any Guide will remain available, unchanged, or supported after purchase.

9.2 We may amend these Terms at any time. The version of these Terms in effect at the time of your purchase will govern that purchase; continued use of our website after any amendment constitutes acceptance of the amended Terms for future purchases.

10. Governing Law and Disputes

10.1 These Terms are governed by the laws of [Insert Jurisdiction], without regard to conflict-of-law principles, except to the extent mandatory consumer protection laws of your country of residence apply.

12.1 These Terms constitute the entire agreement between you and Marine Tech regarding your purchase and use of Guides, and supersede any prior agreements or understandings, whether written or oral.
